These terms govern your use of this website and purchases from Apex Flow Pets, which is operated by Apex Flow Labs LLC (“we”, “us”), Galt, California. By using the website or placing an order you agree to them. If you do not agree, please do not use the website.
Eligibility
You must be at least 18 years old and able to form a binding contract to buy from us.
Orders and pricing
- Prices are in US dollars. Your order total, with any shipping and sales tax, is shown at checkout before you pay.
- An order is an offer to buy. It becomes a contract when we ship it or confirm it by email. We may decline or cancel an order, for example for suspected fraud, a pricing or description error, or lack of stock, and if we do after you paid we will refund you in full.
- We try to show prices accurately. If a price is wrong we will tell you and you can confirm at the correct price or cancel for a full refund.
- Payment is taken at Shopify checkout. By ordering you confirm you are authorized to use the payment method.
Shipping, returns and refunds
See the Shipping Policy and the Returns & Refunds Policy. They are part of these terms. Nothing in them limits your rights under consumer law.
Product information
Product descriptions, specifications, photos and sizes come from manufacturers and suppliers and from our own summaries. We work to keep them accurate, but they can contain errors and photos may differ slightly from what arrives. Our “Product truth” blocks and guides are general information, not a warranty or a promise of results. See Disclosures.
Pets, supervision and veterinary matters
Pet products can fail, be chewed or outgrown, and can injure a pet or person if used badly. Nothing on this website is veterinary advice, and nothing is sold to diagnose, treat, cure or prevent any illness or condition in an animal. You are responsible for choosing the right size and type for your pet, supervising its use, checking the product for wear before every use, and stopping use if it is damaged. By ordering you confirm you have read the Pet safety and supervision page. If you use a camera or microphone product, you are responsible for complying with recording and privacy laws, including the consent rules that apply to recording people (California requires consent of everyone recorded in a private conversation).
Safety and your responsibility
Read the Pet safety and supervision page, the product page and the manufacturer’s instructions before use, and use products only as intended. You are responsible for choosing products that suit you and for using them safely.
Acceptable use
Do not misuse the website: no scraping that burdens the site, probing for security weaknesses, interfering with its operation, using it for unlawful purposes, or reselling content from it without permission.
Intellectual property and links
The website’s text, design and code belong to Apex Flow Labs LLC or its licensors. Brand names and trademarks of manufacturers belong to their owners, and we are not affiliated with them unless we say so. To report an infringement, use Report a concern. We are not responsible for other websites we link to.
Warranties and limits of liability
Products carry whatever warranty the manufacturer gives and the warranties the law implies in your state. Apart from those, and to the extent the law allows, the website and our guides are provided “as is” and “as available” without other warranties, and we do not guarantee any particular result from using a product.
To the extent the law allows, Apex Flow Labs LLC is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms excludes liability that cannot legally be excluded, including for death or personal injury caused by our negligence, fraud, or anything that consumer-protection law does not let us limit. Some places do not allow some of these limits, so they may not apply to you.
Disputes and governing law
If something goes wrong, please email us first at info@apexflowlabs.com; most problems can be fixed quickly and we will respond within one business day. These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You and we agree that disputes that cannot be settled informally will be brought in the state or federal courts located in California, except that you may bring a claim in small-claims court in your county, and any consumer-protection right you have to sue where you live is not affected.
Changes
We may update these terms. The version on this page when you place an order applies to that order.
